2 Scope of Services

GOMAT Cargo Services GmbH (“GOMAT”) provides freight forwarding, logistics coordination, cargo consolidation, customs support, warehousing, procurement support, and related services.

GOMAT acts as a freight forwarder and logistics intermediary unless expressly agreed otherwise in writing. All services are subject to availability, applicable laws, and written agreement.

3 Quotations & Contracts

  • Quotations are non-binding unless confirmed in writing.
  • Rates are subject to change due to fuel, customs, or carrier charges.
  • A binding contract exists only upon written acceptance.

4 Client Obligations

The Client shall ensure that all goods, shipment instructions, declarations, documentation, and information provided to GOMAT are accurate, lawful, complete, and compliant with all applicable regulations.

The Client warrants that the goods do not violate export controls, sanctions, customs laws, or any applicable national or international regulations. Failure to comply may result in refusal or suspension of service.

5 Customs & Compliance

Clients are responsible for the accuracy of customs declarations and documentation. GOMAT acts as an intermediary and is not liable for penalties arising from incorrect information supplied by the client.

6 Compliance, Fraud Prevention & Legal Notice

GOMAT Cargo Services GmbH operates strictly in accordance with applicable German, European Union, and international laws and regulations governing freight forwarding, logistics, customs, and trade compliance.

The Client acknowledges and agrees that:

  • No unauthorised representation: GOMAT does not authorise any third party to use its company name, registered address, warehouse facilities, or identities without prior written authorisation.
  • Prohibition of misuse: Any unauthorised use of GOMAT’s corporate identity for fraudulent, misleading, or unlawful purposes is strictly prohibited.
  • Client responsibility: The Client warrants that all shipment details are accurate and lawful. The Client shall indemnify GOMAT against any loss arising from false or unlawful information.
  • Right to refuse service: GOMAT reserves the right to terminate services without liability where there is suspicion of fraud, identity misuse, or violation of laws.
  • Legal consequences: Misuse of GOMAT’s corporate identity may constitute criminal offences under German law (StGB) and result in prosecution.

7 Limitation of Liability

GOMAT’s liability is limited in accordance with the German Commercial Code (Handelsgesetzbuch – HGB) and applicable international conventions. We are not liable for:

  • Indirect or consequential losses.
  • Delays caused by customs, authorities, force majeure, or third parties.
  • Losses arising from incorrect client information.

Cargo insurance is recommended.

8 Insurance

Unless expressly agreed in writing, shipments are not insured by default. Insurance may be arranged upon request at additional cost.

9 Payment Terms

  • Invoices are payable within the agreed timeframe.
  • Late payments may incur interest and recovery costs.
  • GOMAT reserves the right to withhold services for unpaid balances.

10-13 General Provisions

Procurement: Where GOMAT provides procurement services, it acts as an intermediary and does not guarantee manufacturer performance.

Website Use: Users must not use the website unlawfully, misuse company branding, or attempt unauthorised access.

Intellectual Property: All content is the property of GOMAT Cargo Services GmbH. Unauthorised use is prohibited.

Termination: GOMAT may suspend services where legal risks arise, payment obligations are breached, or fraud is suspected.

14 Governing Law & Jurisdiction

These Terms & Conditions are governed by the laws of the Federal Republic of Germany. Place of jurisdiction shall be Germany, unless otherwise required by mandatory law.
